Rechtsgrundlage ist Art. 6 Abs. 1 lit. a DSGVO.
Habs schreibt keine Daten in Apple Health.
Daten in Apple Health bleiben davon unberührt.
The controller responsible for data processing on the website bytetro.app (including habs.bytetro.app) and in the Habs app is:

No data protection officer has been appointed, as there is no legal obligation to do so.
This policy covers both the website and the Habs app. The app processes all data exclusively on your device. It has no user accounts, no servers, and sends no data to me or to third parties. The website does not set cookies and does not use any analytics or tracking services.
No automated decision-making or profiling takes place. You are not obliged to provide me with any data. Without the technical connection data, however, the website cannot be displayed.
The website is served as static files by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Whenever a page is requested, the host automatically processes technical data: IP address, date and time of the request, the page requested, the referring page, and browser and device type.
This processing is necessary to deliver the website and to keep it secure and stable, for example to detect abuse. The legal basis is Art. 6(1)(f) GDPR. My legitimate interest is the secure and reliable operation of the website. A data processing agreement under Art. 28 GDPR is in place with the host. Log data is kept only as long as needed for these purposes and is not combined with any other data.
Data may be transferred to the United States. The host is certified under the EU-U.S. Data Privacy Framework, which is covered by an adequacy decision of the European Commission (Art. 45 GDPR). The European Commission's Standard Contractual Clauses apply in addition. For more information, see Cloudflare's privacy policy.
The website sets no cookies, uses no analytics, tracking pixels or advertising, and embeds no third-party content. Fonts and icons are served from the website's own server, so no connection to Google or any other provider is made.
The website links to the App Store and to an email address. You only leave this website once you follow such a link. From then on, the privacy policy of that provider applies.
If you email me, I process your email address and the content of your message to answer your request. The legal basis is Art. 6(1)(b) GDPR where your request relates to using the app, and Art. 6(1)(f) GDPR otherwise. My legitimate interest is responding to your request.
Emails are processed through iCloud+ by Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. Data may also be transferred to the United States. Apple is certified under the EU-U.S. Data Privacy Framework. I delete your message once your request has been fully handled, unless statutory retention obligations apply.
All data you enter in the app is stored exclusively on your device (using Apple SwiftData). This includes:
The legal basis is Art. 6(1)(b) GDPR, insofar as processing is necessary to use the app.
Settings such as notifications, haptic feedback, vacation mode (including its periods), the to-do feature, and display options are stored locally using Apple UserDefaults. This data never leaves your device.
If you choose, the app reminds you of your habits. This only happens with your consent. Notifications are created directly on your device and may contain a habit's name and the reminder time. No push services, servers, or external providers are used. The legal basis is Art. 6(1)(a) GDPR. You can withdraw your consent at any time in the iOS Settings.
You can optionally link habits to data from Apple Health. The app then reads only the data you have explicitly granted access to: step count, active energy burned, and sleep analysis including sleep stages. Habs does not write any data to Apple Health.
Health data is not stored permanently in the app. It is used only for display and calculations on your device and is never transmitted to anyone. The legal basis is your explicit consent under Art. 9(2)(a) GDPR. You can withdraw it at any time in the Health settings of iOS.
The app itself contains no analytics, no advertising, no telemetry, no crash reporting, and no third-party SDKs. There is no iCloud sync and no other network communication. The app uses only frameworks provided by Apple (including SwiftUI, SwiftData, HealthKit, UserNotifications, and Charts).
If you have enabled iCloud or computer backups of your device, data stored locally by the app may be included in those backups. This depends solely on your device settings and Apple's terms. I have no access to it.
Your data stays on your device until you delete it. You can remove all habits, entries, and tasks using “Delete Data” in the app. When you delete the app, iOS removes its locally stored data. Data in Apple Health is not affected.
The app is distributed through Apple's App Store. Apple is responsible for downloads, updates, and your Apple Account, and Apple's privacy policy applies. If you have agreed to share analytics in your device settings, Apple provides me with aggregated, anonymous statistics (such as the number of downloads or crashes). These do not allow me to identify individual people.
Where personal data is processed, you have the following rights under the GDPR:
Since app data exists only on your device, you can exercise these rights there directly. I have no access to it. For anything else, simply email habs@bytetro.app.
Right to object (Art. 21 GDPR): Where processing is based on Art. 6(1)(f) GDPR, you may object to it at any time on grounds relating to your particular situation.
Right to lodge a complaint: You may lodge a complaint with a data protection supervisory authority. The authority responsible for me is the State Commissioner for Data Protection of Lower Saxony (Die Landesbeauftragte für den Datenschutz Niedersachsen), Prinzenstraße 5, 30159 Hannover, Germany.
I will update this policy if the website, the app, or the law changes. The version published here always applies.
